FCA Weighs Easing UK Prediction Market Ban After Talks

FCA considers easing the UK prediction market ban following regulatory and industry discussions.

Summary :

  • The FCA has held talks with platforms on retail prediction market access.

  • No policy change, draft rules or timetable has been announced.

  • Industry says millions of Britons use VPNs to trade on Kalshi and Polymarket.

  • Financial contracts sit with the FCA; sports and politics with the Gambling Commission.

  • The FCA permanently banned retail binary options in April 2019.

The UK's ban on retail prediction markets is doing the one thing bans reliably do: pushing the activity offshore. The Financial Conduct Authority has held exploratory talks with trading platforms after a surge in Britons bypassing UK rules to use American sites such as Kalshi and Polymarket, industry representatives told the regulator, with millions of users reaching the platforms via VPN. So far the FCA has announced no policy change, no draft rules and no timetable. The talks are a pressure gauge, not a policy.

Why the 2019 Ban No Longer Fits

The FCA permanently banned retail binary options in April 2019 over provider conflicts of interest, loss rates and valuation difficulty, and financial and climate prediction contracts still sit inside that definition. But the market has changed shape around the ban. Kalshi operates as a CFTC-regulated designated contract market now integrated into mainstream US brokers, Coinbase expanded a prediction deal with it, and Polymarket runs the same contracts on public blockchains, the venue whose cultural reach the UK already met when Polymarket signed LeBron James. The US has scrutinized suspicious wagers on military events for potential insider access, which cuts both ways in this argument: it shows the products carry real integrity risk, and that a regulator can engage instead of only prohibiting.

The UK's dual framework adds friction no platform wants: financial and climate markets answer to the FCA, sports and politics to the Gambling Commission, which warned in February 2026 that prediction platforms meet the definition of betting intermediaries and that unlicensed overseas operators should not target UK residents. A global platform needs both licenses, in a country whose consumers, using VPNs, have neither ombudsman recourse nor Financial Services Compensation Scheme protection. The March 2026 perimeter report hinted the FCA may judge products by underlying risk rather than labels, the door through which a regulated retail market could enter.

What a Reversal Would Actually Require

Do not mistake talks for a thaw. Formal proposals would need risk warnings, suitability checks and a definition separating event contracts from the binary options ban, likely with the FSCS question priced into fees, the same consumer-protection tradeoff MiCA forced European exchanges to price. The FCA has no verified figures on British VPN volume, so the demand case rests on industry claims.

Watch for a consultation paper, the first real signal. If it lands, the UK becomes the first major market to walk back a binary option ban for risk-based rules, and Robinhood and Coinbase, both already FCA-registered, are positioned at the front of that queue.
