CLARITY Act Ethics Text: Trump-Backed Rule Bars Officials From Issuing Crypto — but Hands Enforcement to His Own DOJ

CLARITY Act Ethics Text: Trump-Backed Rule Bars Officials From Issuing Crypto — but Hands Enforcement to His Own DOJ
The CLARITY Act ethics proposal would bar federal officials from issuing cryptocurrencies, but Democrats are objecting because enforcement would be handled by the Justice Department rather than state attorneys general.

The long-awaited ethics language for the crypto market-structure bill has finally surfaced — and it may have swapped one deadlock for another. According to three sources who spoke to The Block, the newly approved provisions that President Donald Trump signed off on would prohibit federal officials from issuing cryptocurrencies, while placing the Justice Department, rather than state attorneys general, in charge of enforcing the rule. The enforcement choice is already shaping up as a fresh flashpoint in the fight to pass the CLARITY Act.

What the Provision Says

The language would bar federal officials — including members of Congress, the president, and the vice president — from issuing digital assets, three sources told The Block, with details also reported by Crypto in America's Eleanor Terrett and The Hill's Julia Shapero. Word of the text emerged during a Tuesday afternoon industry call featuring White House top crypto adviser Patrick Witt. It follows Trump's agreement late Monday to ethics terms after months of negotiations over how to stop presidents, vice presidents, lawmakers, and other officials from profiting from digital assets while in office — the final hurdle standing between the sweeping bill and passage.

The DOJ Problem

The sticking point isn't the prohibition itself — it's who enforces it. By naming the Justice Department as chief enforcer and cutting out state attorneys general, the provision runs headlong into a Democratic demand that states retain some oversight authority, two sources confirmed. The objection has obvious logic: a rule meant partly to constrain the sitting president would be enforced by that president's own DOJ.

The context sharpens the concern. At the center of the ethics debate are Trump's memecoins and his family's company, World Liberty Financial — and financial disclosures released last month showed Trump received millions of dollars tied to WLF, intensifying scrutiny of how tough the safeguards really are. Senator Angela Alsobrooks (D-Md.), a key CLARITY Act negotiator, didn't mince words, calling DOJ enforcement of an ethics provision an unserious offer she couldn't support as written — while signaling she'd keep working from that starting point toward language that holds everyone accountable.

Where It Leaves the Bill

The White House declined to confirm the provision's exact wording but said it is working with lawmakers to pass CLARITY — and preemptively assigned blame, arguing that if Senate Democrats block the legislation after the administration accommodated their concerns, it's the Democrats who were never serious about a deal. Democrats, for their part, see an enforcement mechanism designed to be toothless where it matters most.

The result is a familiar impasse in new clothing. Trump has now signed off on ethics language, clearing the obstacle Republicans said was the last one — but the enforcement question has simply moved the fight rather than ending it. With the Senate's pre-recess window narrowing, whether negotiators can bridge the DOJ-versus-states gap will determine if the crypto industry's top legislative priority reaches a floor vote or stalls yet again.
