Regulation Overview

The United Kingdom is transitioning from a limited crypto perimeter to a broader financial-services regime. Cryptoasset exchange and custodian-wallet providers within scope must register with the FCA for AML supervision. Promotions of qualifying cryptoassets to UK consumers have been regulated since 8 October 2023 and must use a lawful communication route and comply with FCA rules. The Financial Services and Markets Act 2000 (Cryptoassets) Regulations 2026 create regulated cryptoasset activities and a new authorisation regime due to commence on 25 October 2027. Until then, FCA AML registration should not be described as full prudential authorisation.

Tax Information

HMRC taxes crypto according to existing tax principles. Personal investment disposals usually fall under Capital Gains Tax, while mining, staking, employment receipts and trading activity can produce Income Tax and National Insurance consequences.

Individual Tax Treatment

Selling, swapping, spending or gifting tokens can be a CGT disposal. Tokens received through employment, mining, staking, lending or DeFi may be income when received and can create a later capital gain or loss on disposal.

Business Tax Treatment

Companies generally apply corporation-tax rules to crypto profits and losses and must value transactions in sterling. Businesses must also consider VAT, payroll, reporting and financial-promotion rules.
HM Revenue & Customs

Business & Licensing

Current in-scope exchange and custody businesses need FCA AML registration. Firms carrying on regulated cryptoasset activities under the future regime will need FSMA permission from 25 October 2027, subject to transitional arrangements.

AML / KYC Requirements

FCA-registered crypto businesses must apply risk assessment, KYC, beneficial-owner checks, monitoring, recordkeeping, sanctions and suspicious-activity reporting under the Money Laundering Regulations.
