Regulation Overview

MiCA governs crypto-asset issuance, stablecoins, public offers, market conduct and crypto-asset services in France. The Autorité des marchés financiers processes CASP authorisations with prudential involvement from the ACPR where relevant. France's earlier PACTE-law DASP regime has transitioned to MiCA, and old-only DASPs were delisted after the transition. Financial-instrument tokens remain under securities law; truly unique NFTs and fully decentralised arrangements require scope analysis.

Tax Information

Private occasional disposal gains are generally subject to a 30% combined flat rate, with an option for the progressive income-tax scale. Professional activity and businesses follow different rules.

Individual Tax Treatment

Taxable disposals into fiat, goods or services are calculated under the digital-asset portfolio method and reported with the required forms. Crypto-to-crypto exchanges can receive deferral treatment under the statutory conditions.

Business Tax Treatment

Professional dealing, mining, staking and corporate holdings are taxed under the applicable business or corporate regime. VAT and accounting treatment depend on the service and token.

Business & Licensing

A professional CASP serving France requires MiCA authorisation from an EU competent authority and, where cross-border, the proper passport notification. Token issuers must satisfy applicable white-paper and stablecoin rules.

AML / KYC Requirements

CASPs must apply EU and French AML/CFT rules, customer due diligence, beneficial-owner checks, monitoring, travel-rule data, sanctions screening and suspicious-reporting obligations.
