Crypto Groups Seek Injunction Against Illinois Digital Asset Tax

Crypto Groups Seek Injunction Against Illinois Digital Asset Tax
Crypto trade groups including the Blockchain Association and Crypto Council for Innovation filed suit to block Illinois' first-in-the-nation 0.2% digital asset tax before its January 2027 effective date.

Cryptocurrency trade groups are asking an Illinois court to block the nation's first state-level tax on digital asset transactions, arguing the 0.2% levy violates both the U.S. and Illinois constitutions and discriminates against the crypto industry. The lawsuit escalates a legal fight that could determine whether other states follow Illinois in taxing crypto activity.

The Digital Asset Tax Act

Illinois passed the Digital Asset Tax Act, which imposes a 0.2% tax on the value of digital assets exchanged, transferred, or stored by customers in the state. The law is scheduled to take effect on Jan. 1, 2027. It was signed by Governor J.B. Pritzker alongside the Digital Asset Kiosk Act as part of a broader regulatory framework for digital assets.

The tax applies to businesses facilitating crypto transactions for Illinois residents, not to peer-to-peer transfers between individuals. Critics argue the tax would drive crypto businesses out of Illinois and reduce consumer access to digital asset services.

Who Is Suing

The Blockchain Association and Crypto Council for Innovation filed the lawsuit in Cook County Circuit Court seeking to declare the Digital Asset Tax Act unlawful. The complaint asks the court to enter preliminary and permanent injunctive relief barring the state from enforcing the tax.

Crypto advocates have since joined the legal challenge, adding more pressure on Illinois lawmakers. The industry argues that the tax amounts to a discriminatory levy on a specific technology, creating an uneven playing field compared to traditional financial transactions that face no equivalent state-level tax.

Constitutional Arguments

The plaintiffs argue the tax violates the U.S. Constitution's Commerce Clause by interfering with interstate commerce in digital assets. They also claim it conflicts with Illinois constitutional limits on taxation and creates an undue burden on innovation in the state.

The case could set a precedent for other states considering similar crypto tax measures. If Illinois succeeds in implementing the tax, lawmakers in other states may view it as a revenue model worth replicating. If the court blocks it, the ruling could discourage similar legislation elsewhere.

What Comes Next

The court has not yet ruled on the request for a preliminary injunction. If granted, the injunction would prevent the tax from taking effect while the lawsuit proceeds. The case is being closely watched by both the crypto industry and state tax authorities nationwide.

The outcome will shape how states approach crypto taxation for years to come. For now, crypto businesses operating in Illinois face uncertainty about whether the 0.2% tax will take effect as scheduled or be blocked by the courts.
