CFTC Resolves FTX Cases Against Ellison and Wang

CFTC Resolves FTX Cases Against Ellison and Wang
CFTC resolved cases against FTX's Caroline Ellison and Gary Wang, imposing trading and registration bans while sparing them from fines for cooperation.

The Commodity Futures Trading Commission has resolved its enforcement cases against two former FTX executives, imposing multi-year trading and registration bans while sparing them from financial penalties in recognition of their cooperation with investigators.

Caroline Ellison, former CEO of Alameda Research, and Gary Wang, former chief technology officer of FTX, received final consent orders from the CFTC resolving their civil cases related to the collapse of the cryptocurrency exchange. The orders formalize penalties that had been anticipated since both individuals pleaded guilty to criminal charges and cooperated with prosecutors in the case against FTX founder Sam Bankman-Fried.

The Penalties Imposed

Ellison was hit with a five-year trading ban and a ten-year ban from CFTC registration. The CFTC found Ellison liable on two fraud counts related to her role in misappropriating FTX customer funds through Alameda Research. She was sentenced to two years in prison in September 2024 and was released from custody in January 2026.

Wang received a five-year trading ban and an eight-year registration ban. The CFTC found him liable on a single fraud count. Wang received no prison sentence, reflecting his early cooperation with investigators and his role as a witness in the case against Bankman-Fried. The differing penalties reflect the different levels of responsibility assigned to each individual in the fraud.

Cooperation as Mitigating Factor

The CFTC's decision to spare both individuals from financial penalties underscores the value of cooperation in regulatory enforcement. Both Ellison and Wang provided substantial assistance to investigators, helping to unravel the complex web of transactions that led to FTX's collapse and the loss of approximately $8 billion in customer funds.

Their testimony was instrumental in the criminal conviction of Bankman-Fried, who was found guilty on multiple counts of fraud and conspiracy. The CFTC's consent orders require both individuals to continue cooperating with the agency, leaving open the possibility that their testimony could be used in future enforcement actions against other parties involved in the FTX collapse. The Broader FTX Aftermath

The resolution of the CFTC cases against Ellison and Wang marks another milestone in the ongoing legal aftermath of FTX's November 2022 collapse. The CFTC had previously obtained a $12.7 billion judgment against FTX and Alameda Research, one of the largest penalties ever imposed in a crypto-related enforcement action. The exchange's bankruptcy estate has been working to return funds to creditors, with recoveries exceeding expectations due to the appreciation of certain crypto assets held by the estate.

While the criminal cases against the main perpetrators have concluded, civil litigation continues. Class-action lawsuits seeking additional compensation for FTX customers are working their way through the courts, and regulatory investigations into other parties connected to the exchange, including auditors and promotional partners, remain ongoing. What This Means for Crypto Regulation

The CFTC's resolution of the Ellison and Wang cases demonstrates the agency's approach to individual accountability in crypto fraud cases. By imposing trading and registration bans while sparing cooperative witnesses from financial penalties, the CFTC creates incentives for individuals involved in fraud schemes to come forward and cooperate with investigators.

The trading and registration bans effectively prevent both individuals from holding positions of responsibility in the regulated crypto markets for years to come. While neither has indicated an intention to return to the crypto industry, the bans ensure that any future attempt to do so would face regulatory scrutiny. The cases also reinforce the CFTC's role as a primary regulator of crypto derivatives and futures markets, a role that may expand depending on the outcome of the CLARITY Act legislation currently before Congress.
