Bitwise Says Crypto Can Advance Even If CLARITY Act Stalls

Bitwise Says Crypto Can Advance Even If CLARITY Act Stalls
Crypto markets may continue to grow even if the CLARITY Act misses its August window, according to a broader industry view that separates blockchain adoption from a single piece of legislation.

Crypto's development may not depend entirely on whether the CLARITY Act clears Congress this year. With the bill facing a narrowing schedule and market expectations for passage weakening, investors are debating whether a legislative delay would halt adoption or simply extend a period of regulatory uncertainty. One prominent industry view is that the underlying expansion of digital assets can continue even without an immediate federal market-structure law.

A More Nuanced View of Legislative Risk

Regulation matters because it shapes the cost and confidence of building in the United States. Yet the relationship between a bill and an industry is rarely binary. A delay can slow decisions, increase legal expenses, and push some companies toward friendlier jurisdictions without stopping every project already supported by customer demand or existing approvals. That nuance is especially important after years of development across custody, stablecoins, payments, and tokenization. Many of these businesses are being built around defined products with established compliance processes. They may benefit from a comprehensive framework, but they are not waiting for one vote before serving users. The argument for continued growth rests on that wider industry base.

What a Delay Would Still Cost

A stall would not be harmless. Exchanges and token issuers could remain uncertain about the boundary between securities and commodities, while financial institutions may continue to limit products that require clear federal authority. Venture investors could also demand higher returns to compensate for policy risk. Smaller companies would feel the burden most sharply because they have fewer resources for prolonged legal and compliance work. A bill that arrives later could still be valuable, but the cost of waiting is measured in slower launches, postponed hiring, and missed opportunities to establish US-based infrastructure.

Adoption Has Multiple Engines

Digital-asset growth is now supported by several independent engines. Stablecoins are being used for settlement and dollar access, banks are testing tokenized assets, and investors are seeking regulated exposure through funds and custody providers. These developments can move forward through a combination of agency guidance, state rules, private contracts, and international competition. Institutional infrastructure is particularly resilient because large firms tend to build in stages. A custodian may begin with safekeeping, add reporting, then expand into settlement or staking once operational controls are ready. The expansion of institutional staking services illustrates how product development can continue alongside unresolved policy questions.

The Market's Two Timelines

Crypto markets are operating on two timelines. The first is the political timeline, measured in filing deadlines, committee negotiations, and recesses. The second is the commercial timeline, measured in user growth, transaction volume, product launches, and the gradual movement of financial activity onto blockchain networks. A disappointing legislative update can hurt prices in the short term because traders discount future growth. But if commercial adoption continues, the longer-term impact may be smaller than the initial reaction. Conversely, a breakthrough could lift sentiment without immediately changing the fundamentals of a product that still needs customers and reliable execution.

What to Watch Beyond the Bill

Investors should track whether financial institutions keep expanding digital-asset offerings, whether stablecoin settlement volumes grow, and whether regulators provide clarity through means other than Congress. These signals will help distinguish a temporary policy setback from a broader deterioration in the sector's operating environment. The CLARITY Act remains important, but it is not the only measure of crypto's future. A delay could preserve uncertainty, yet the industry's ability to build through that uncertainty may determine how much influence the eventual law has over a market that continues to evolve in the meantime.
