Regulation Overview

Thailand's Emergency Decree on Digital Asset Businesses regulates exchanges, brokers, dealers and token offerings, with licences granted by the Ministry of Finance on SEC recommendation. The SEC maintains licensed and unauthorised-platform information and imposes custody, capital, advertising, cybersecurity and market-conduct requirements. The Bank of Thailand controls payment and financial-institution use. Crypto payments as a broad means of payment are restricted, although regulated investment trading is permitted.

Tax Information

Crypto gains and rewards can be taxable personal or business income. Transactions through licensed exchanges may receive specific VAT treatment, while withholding and filing depend on transaction structure.

Individual Tax Treatment

Individuals should report assessable gains and reward income under Thai personal income-tax rules and keep baht-valued transaction records. Loss and withholding treatment should be checked annually.

Business Tax Treatment

Digital-asset businesses account for income, corporate tax, VAT treatment, withholding and regulatory fees. Token issuers and operators have additional reporting duties.
