Regulation Overview

MiCA governs crypto-asset issuers, stablecoins, offers and CASPs in Portugal. Banco de Portugal accepts CASP authorisation and notification applications; securities-token matters can involve CMVM. The prior AML-only VASP register is no longer a substitute for MiCA authorisation. Crypto is not euro legal tender. National income-tax rules introduced a specific framework for qualifying crypto disposals from 2023.

Tax Information

For qualifying crypto assets, individual gains on assets held at least 365 days are generally exempt, while shorter-held net gains are generally taxed at 28%; business/professional and excluded-token cases differ.

Individual Tax Treatment

Holding period, token classification, tax residence and whether proceeds are reinvested in crypto affect treatment. Reportable income such as mining, staking or professional trading follows separate categories.

Business Tax Treatment

Professional and corporate crypto activity is taxed under business/corporate rules, with accounting, VAT, payroll and reporting consequences determined by the service.

Business & Licensing

CASPs require MiCA authorisation or a valid EU passport. Token issuers must comply with white-paper and stablecoin requirements; financial-instrument tokens may require CMVM permissions.

AML / KYC Requirements

CASPs apply Portuguese/EU AML rules, including customer and beneficial-owner due diligence, monitoring, travel-rule data, sanctions screening and suspicious-reporting.
