Regulation Overview

Cryptoassets are lawful but not New Zealand legal tender. Platforms and token businesses must assess whether they provide a financial product, financial advice, derivatives, managed investment, money/value transfer or another regulated service. Virtual-asset service businesses may need Financial Service Providers Register entry, dispute-resolution membership and AML/CFT supervision. The FMA warns that many crypto products have limited protections. A bespoke full-market crypto regime remains under development.

Tax Information

Inland Revenue treats cryptoassets as property. In many cases profits from selling, trading or exchanging are taxable income because of acquisition purpose or business activity; GST treatment has special cryptoasset rules.

Individual Tax Treatment

Taxable events can include sale, swap, gifting and purchases with crypto. Individuals must keep New Zealand-dollar records of acquisitions, disposals, fees and income such as mining or staking rewards.

Business Tax Treatment

Businesses include crypto receipts and taxable gains in income, account in New Zealand dollars and apply payroll, GST and deduction rules according to the activity.

Business & Licensing

There is no single general exchange licence. Operators must map services to financial-markets, FSPR, derivatives, custody, payment and AML obligations and obtain any required registration or licence.

AML / KYC Requirements

Covered VASPs and money/value-transfer services must conduct customer due diligence, beneficial-owner checks, monitoring, recordkeeping and suspicious-activity reporting under the AML/CFT Act.
