Regulation Overview

Mexico's Fintech Law defines virtual assets and allows regulated fintech institutions to operate with those authorised by Banco de México. The central bank has maintained a restrictive separation between regulated financial institutions and public crypto exposure. Independent platforms can fall within AML vulnerable-activity rules administered through SAT. Securities, consumer and advertising rules can apply depending on the product. The Mexican peso remains legal tender.

Tax Information

Mexico has no single simple retail crypto-tax regime. Disposals, business receipts and mining can create income tax, VAT and reporting obligations under general federal tax rules.

Individual Tax Treatment

Individuals should determine whether a disposal creates taxable gain and retain peso-valued acquisition and sale records. Frequency, source and business character can affect classification.

Business Tax Treatment

Businesses account for crypto receipts and gains under ordinary corporate and VAT rules and must meet invoicing, accounting and AML reporting duties where applicable.

Business & Licensing

Fintech institutions need CNBV authorisation and Banco de México approval for permitted virtual-asset operations. Non-financial platforms must assess AML vulnerable-activity registration and notices.

AML / KYC Requirements

Covered platforms must identify customers and beneficial owners, preserve records, monitor thresholds and submit notices under Mexico's AML vulnerable-activity regime.
