Regulation Overview

El Salvador adopted the Bitcoin Law in 2021 and substantially amended it through Legislative Decree No. 198 of 29 January 2025. The reform removed mandatory private acceptance and limited the state's obligation to accept Bitcoin, making its commercial use voluntary. Bitcoin and other digital-asset activities remain lawful, and the Digital Assets Issuance Law provides a separate framework for public offerings and digital-asset service providers. The U.S. dollar is the unit used for public accounts and taxes. Because the post-reform legal-tender wording has been interpreted differently, Bitnxt classifies Bitcoin's legal-tender status as limited rather than presenting it as unrestricted legal tender.

Tax Information

General income, business and VAT rules continue to apply. Following the 2025 Bitcoin Law reform, taxes are paid in U.S. dollars rather than through a mandatory Bitcoin-payment channel.

Individual Tax Treatment

Tax treatment depends on whether the activity is an investment, business or regulated digital-asset issuance. The amended Bitcoin Law and ordinary income-tax rules should be checked before relying on earlier claims of broad Bitcoin tax exemption.

Business Tax Treatment

Businesses must account and pay taxes in U.S. dollars and apply ordinary Salvadoran income and VAT rules. Digital-asset issuers and service providers must also consider the Digital Assets Issuance Law.

Business & Licensing

Public digital-asset offerings and regulated digital-asset service activities fall under the Digital Assets Issuance Law and the National Commission of Digital Assets. Ordinary Bitcoin acceptance by a merchant is voluntary and is not itself a licence.

AML / KYC Requirements

Regulated digital-asset service providers must follow registration, AML/KYC, governance and reporting requirements under the digital-assets framework and general AML law.
